Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Trainova LLC (“Trainova,” “we,” “our,” or “us”) governing your access to and use of the Trainova mobile application (the “App”) and related services.
By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the App.
Eligibility
You must be at least 18 years of age to use the App.
By using Trainova, you represent and warrant that:

You have the legal capacity to enter into these Terms

You are not prohibited from using the App under applicable laws
User Conduct
You agree not to:

Harass, abuse, threaten, or harm any individual

Post, transmit, or share content that is unlawful, defamatory, obscene, or otherwise objectionable

Impersonate any person or misrepresent your identity

Use the App for any illegal, fraudulent, or unauthorized purpose

Interfere with or disrupt the App or its systems
Trainova reserves the right to remove content and take appropriate action, including account termination.
Subscriptions and Payments
Trainova may offer paid features and subscription plans.

All payments are processed through third-party platforms (e.g., Apple App Store, Google Play)

Subscriptions automatically renew unless canceled

You are responsible for managing and canceling subscriptions through your platform provider

All purchases are final and subject to the policies of the applicable platform
Trainova does not control and is not responsible for third-party payment processing.
Account Termination
Trainova may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms.
You may delete your account at any time through the App.
Upon termination, your right to use the App will immediately cease.
User Accounts
To access certain features, you must register for an account.
You agree to:

Provide accurate, current, and complete information

Maintain and promptly update your information

Maintain the confidentiality of your login credentials

Accept full responsibility for all activities under your account
Trainova reserves the right to suspend, restrict, or terminate accounts at its sole discretion.
Safety and User Interactions
Trainova facilitates connections between users but does not verify users or conduct background checks.
You acknowledge and agree that:

You interact with other users at your own risk

Trainova is not responsible for the conduct of any user

You are solely responsible for your interactions and personal safety
Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Trainova disclaims all warranties, express or implied, including but not limited to:

Merchantability

Fitness for a particular purpose

Non-infringement

Accuracy or reliability of content
Trainova does not guarantee uninterrupted, secure, or error-free operation.
Limitation of Liability
To the maximum extent permitted by law, Trainova shall not be liable for any:

Indirect, incidental, consequential, or punitive damages

Loss of data, revenue, or profits
-
Damages arising from user interactions
In no event shall Trainova’s total liability exceed the amount you paid to Trainova (if any) in the preceding 12 months.
Indemnification
You agree to defend, indemnify, and hold harmless Trainova, its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including legal fees) arising from:

Your use of the App

Your violation of these Terms

Your infringement of any rights of a third party
Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or the App shall be resolved exclusively in the courts located in Georgia.
Changes to Terms
Trainova reserves the right to modify these Terms at any time. Updated Terms will be effective upon posting. Continued use of the App constitutes acceptance of the revised Terms.
